347 | Andrew Guthrie Ferguson on How Your Data Will Be Used Against You

In the 18th century, philosopher Jeremy Bentham suggested the Panopticon as a model of a prison where inmates could be constantly observed by just a single prison guard. Although his original idea was never built, the word has come to indicate any system of social control through constant surveillance. Nowadays, we are close to creating such a system, not for prisons, but for our everyday lives. The data about our whereabouts and doings is collected by our smart devices, and available for search by the authorities. I talk with law professor Andrew Guthrie Ferguson about the new reality, as discussed in his book Your Data Will Be Used Against You: Policing in the Age of Self-Surveillance.

Andrew Guthrie Ferguson received his J.D. from the University of Pennsylvania, and an LL.M. from Georgetown University. He is currently a professor of law at George Washington University Law School. He is a member of the American Law Institute (ALI) and was an Advisor to the ALI Principles of the Law, Policing Project. He previously worked as a supervising attorney at the Public Defender Service for the District of Columbia.

  1. This episode really hit home, especially the part where Professor Ferguson talks about the disconnect between rapid technological progress and lagging legal safeguards. I was trying to research some of the specific data privacy tools mentioned in a tech forum and came across this site guiadebetnacionalbrasil.com, but I’m getting a “451 Unavailable For Legal Reasons” error. Is this a concrete example of the kind of “legal architecture” or jurisdictional barriers the Professor was talking about, where access to information is restricted by the state before we even have a chance to manage our own data footprint?

  2. hmmm. Siting president as doing something treasonous? a traitor? someone against Fascists (like those that signed up for WWII in my family, are they Antifa? Tht is, antifacist? Now, is it jail-able to have negative thoughts about an all-positive leader? Or those jailed that are EFFECTIVE OPPOSITION? Make a mock up of former presidents as Apes? Is this ‘No Kings’ idea against the USA? Full disclosure, I willfully tor the tags off pillows, even thought there is a law against it.
    I predict that those with power will be jailed-detained when getting in the way of $ or power. The degree to which this occurs is up to those in power, and how they profit from it.

  4. Please invite privacy activists on your show. There are open source and privacy focused alternatives to the cloud providers. It’s possible for you to own and keep your own data.

  6. As Tim says above, there are tons of open source, privacy focused alternatives for almost anything, and many of them are even better than the closed ones. Just as an example, CoMaps works offline (you just dowload in advance the maps you need), is great and easy to use and for me provides better results than Google maps.
